Mediation May Be Just The Ticket

Divorce is a horrible experience, so please bear in mind the fact that it can be exponentially worse if you approach the process like a war to the death with only one winner on the other side.

When the person you built your life with tells you he/she no longer wish to do life with you, it is a natural, human, feeling to wish negative upon that person or at least to treat them as persona non grata. “Revenge is a dish best served cold” can easily become your guiding principle in life.

Unfortunately, any lawyer will tell you that the most expensive cases, and the cases where both parties end up dissatisfied, are those in which both spouses are angry and neither wants to give an inch. By the time the parties reach agreement on asset valuations, much of the marital estate has already been diminished on litigation fees, attorney fees, accounting fees and private investigator fees.

Before you make a foolish mistake based on nothing other than ego and pride, you should consult with an attorney to develop an action plan for your divorce. A lawyer can tell you some of the do’s and don’ts that will increase your prospects for a settlement on terms you find acceptable.

Once you step in front of judge, you are taking the chance that an adverse decision may deprive you of meaningful contact with your children, or force you to sell your beloved family home at a fraction of its worth in a depressed real estate market.

For many couples, mediation may be a far more satisfactory option than a drawn-out legal battle. The problem is that you have to get your spouse to agree to this format, which seems impossible when a relationship is irretrievably broken and all you want to do is attack and destroy the person who has rejected you.
