When children are involved, divorce proceedings have an additional layer of complication, particularly when it is not clear who will ultimately be named the custodial parent, or when there are allegations of child abuse and mistreatment.
In Connecticut, the health, safety, and wellness of minor children is the primary issue before the family court. While it is generally not the case that a child will hire an attorney, a judge may appoint a Guardian Ad Litem (GAL) to investigate the family circumstances on behalf of the Court, or may require parents to retain an Attorney for the Minor Children (AMC). The child’s attorney acts according to the express wishes of the child (which means the child must be of a mature and appropriate age to have an attorney appointed for them by the Court versus a guardian ad litem), while the more commonly assigned guardian ad litem is a trained children’s advocate who serves the needs of the child and their best interests.
When issues regarding custody and visitation arise, necessitating the appointment of a GAL or AMC, the Court prefers the parents review from the list of qualified professionals to reach agreement as to the GAL or AMC to be appointed. If the parents are unable to reach agreement, the Court will appoint whomever the Court deems appropriate.
Shelton-based attorney Carmina (Tessitore) Hirsch is widely recognized and respected for her work as Guardian Ad Litem (GAL) and Attorney for the Minor Children (AMC). She has the background and training necessary to work on behalf of assisting the Court in determining what is in the children’s best interests as a GAL, and to serve children’s needs and desires as an AMC.
Carmina serves clients throughout New Haven County and Fairfield County, including cities such as Milford, New Haven, Waterbury, Bridgeport, Westport, Stamford and Danbury. Connecticut attorneys have consistently recognized her as a leading attorney for family law matters.
